Xavier Lagarde, Short Reflections on the turnaround for the future
In France, the modulation in time of the effects of the turn-around in case law generates bitter arguments on the ground of principle. One must be pragmatic: legal insecurity is a necessary evil of which one must try to restrain the harmful effects. For this purpose, our law offers legal techniques well adapted (appearance, period of limitation, equity).
