he relationships between these two fundamental principles of the French constitutional system have first been scrutinized on the legal field. The present paper will address the strictly case law period, before 1958, then the constitutional recognition which led to their use by the constitutional judge without, for all that, disregarding the evolution of administrative law cases. But the scrutiny had also to be conducted in the political history of France by establishing the trend towards the supremacy of the equality principle, in particular in Chateaubriand and Tocqueville works. It is the theme of the second part.
