Emmanuel Jeuland, Equality and legal links
The encounter between the equality principle and legal links seems unlikely because the first notion is general and abstract while the second one concretely links different persons. In fact, it turns out that, like the principle of non- overlapping of places, equality is a principle structuring links and groups of legal links. Equality is sought between related persons (for example men and women working in the same firm) and realised through the mediation of a reference third party (the State in particular) necessary to the building of legal links. However, equality is an evolutionary notion which also contributes to the gap in legal links and to disrupt political as well as economic and family links.
