Cyril Nourissat, Equality and European Community Law
The European legal order has given more importance to the expression of discrimination than to that of equality. Almost non existent at the beginning, equality has however been increasingly recognized through the assertion that equal treatment means lack of any discrimination. In an changing perspective, equality has therefore gained ground - in Communiy law not without wondering about a possible dilution effect. New discriminatory criteria, a modulation of the prohibition combined with a recognition by judges to the rank of general principle of Community law make the non-discrimination principle as expression of equality an ever topical data, the outlines of which are however remaining difficult to determine.
