Under the title which may seem somewhat enigmatic of « arbitration of history », the author seeks to relate some of the historical origins of arbitration as it exists in the French Nouveau Code de Procédure Civile. Are by turns considered the distinction between arbiter and amicabilis compositor, homologation and appeal awards. Three key features emerged in medieval times under the combined impulse of practice, medieval Roman law, canon law and jurisprudence.
