Geneviève Giudicelli-Delage, The troubled waters of criminal law in the European Union
The Lisbon Treaty has given criminal jurisdiction to the European Union which it shares with the Member States without, for all that, removing some of the doubts characterizing the evolution that led to the establishment of this jurisdiction. Therefore questions remain unanswered about the outlines of this jurisdiction, the legitimacy of the Union’s intervention and the respect for the principles governing criminal law.

Key Words : European Union – criminal law – harmonization – unification – subsidiarity – necessity – proportionality - lawfulness
