Frédéric Gros, Criminal justice and claim of the victim: last meaning of the sentence
This paper intends to explore four great systems philosophically justifying penalty: recalling the Law; defending society; transforming the individual; answering the victim’s sufferings. This last justification is specially studied on the one hand using a double concep-tual pair (public/private and personal/ media) and on the other hand following the idea of a recodification in therapeutic terms of the subjectivating effects of the criminal pronouncement.
