Paper's abstract

Philippe Jestaz, Beautiful law
Nor plastic nor even formal, the beauty in law speaks only to the mind and lives on argumentation: rhetorical beauty of a thought process that feeds the institutionalised dispute or instrumental beauty of techniques used to settle this dispute. But beyond the dispute arises a more beauty dangerous because of its artificiality: the quasi architectural beauty of explicative theories or of pedagogical systems. In this respect, one must not mistake false clarity with the real elegance of law.
