Marilène Marques, Towards a legal strategy of the organization holding companies?
The strategic approach of a group of multinational corporations is oriented, constrained or facilitated by the multiple determinants of the environment, including the many rules that apply to the group. The real power is held by the holding company, when it directly manages the companies of which it owns and manages the shares. This power can legally be used to optimize the management and even develop legal strategies that can provide a competitive advantage. The implementation of this theory requires a tangible action plan able to transform the legal threats into opportunities conferring a competitive advantage through legal cleverness well controlled within the group.
