Jean-Philippe Robé, Multinational companies, carriers of a new constitutionalism
In recent decades, the world system of global power is upset in its operation. He can no longer cope with the rise of negative externalities generated by the economic exchanges resulting in the degradation of natural environment, financial crises and economic stagnation. One of the many causes of this shift comes from the inclusion in the system of power, of large companies who manage international trade for goods, services and investment. They play a political role completely ignored in the division of regulatory powers inherited from the Westphalia System (System State). Faced with an outdates system of states, a new conception of legal pluralism is needed, to impose, on companies, a supra- legality of the type that States must respect via constitutional law.
