Guillaume Sainteny, Does the Precautionary Principle Deserve So Much Defiance?
The author shows that the precautionary principle is often confused with other principles (notably principles of prevention or preparation). Its formulation in French law is restrictive and, even in this sense, its application by the legislator or in case law is rare. While the precautionary principle requires rigorous and continuous risk assessments, it is wrongly invoked to justify or criticize public decisions that do not fall within its scope.
