Sophie Gambardella, The Precautionary Approach Within International Organizations: A Coherent International Governance For Health And Environmental Risk Management?
The precautionary principle was introduced on the international scene, as well as in domestic legal orders, at the end of the 1980s. Although its legal value is now little contested at a national level, it remains, on the other hand, an object of doctrinal debate among international lawyers. However, the shadow of precaution hangs over the entire international legal system. It infiltrates most normative spaces, reconfigures institutional structures and imposes a renewed dialogue on international organizations. The purpose of this contribution is thus to reveal the metamorphoses that the precautionary approach has brought about in international law.
