Aline Vignon-Barrault, Judges, Precautionary Principle and Relay Antennas
The dispute over the relay antennas, which has now dried up due to the decision of the Tribunal des Conflits of May 14, 2012, which divided the competences between judicial and administrative judges, could see a rebound with the arrival of the 5G, which crystallizes fears and concerns. The reform of civil liability, which is now supported by a Senate bill registered on July 29th, includes certain innovations that offer judges the possibility, for the future, to reinvigorate the precautionary principle and to bring litigants' claims to a successful conclusion.
