Emmanuel Dreyer, Covid 19, Criminal Law and Precautionary Principle
Provisions that follow a precautionary logic as well as a preventive one have overcome the health and social crisis caused by the Covid-19. Indeed, the certainty linked to the existence of this virus was not enough to remove all the grey areas on its treatment. At least at the beginning of the crisis, the very existence of a risk could be discussed. As a result, the provisions adopted, under the threat of criminal sanctions, are partly based on a precautionary logic, the analysis of which calls for mixed comments. The same applies a fortiori to the use of qualifications of ordinary law that prove unsuitable.
