Emmanuelle Berthaud, Sketching the Concept of Relation in the Thought of Ortega y Gasset
The person, the existence of a relation of justice and the presence of others, all these notions play a special role as subjects of study for law philosophy. In what measure has the relation, that which mediates person and justice, been considered by Ortega y Gasset on the one side and some of his disciples who created the orteguian school on the other ? Sweeping over the story of thinking, Ortega thus offers an original definition of man, who is to be understood in the core of a Metaphysic of vital reason. The private and solitary yo is situated in a close convivence with others, following a sub specie et circonstantiarum process. Once transcendental Humanism asserted, the orteguian School then considers Law and Justice through an historical reason, taking social facts as they are, circumstantially, following an ontologically social approach which is the only possible one.
